ROBERT CLARKE, SAN: DISENFRANCHISEMENT WILL RESULT IN POLL ANNULMENT

Well, we have two experiences in recent times. That is the Osun experience and the Ekiti experience where at least if there was disenfranchisement it could not have been significant. 

But these are just two states and we cannot take two states out of 36 as a basis for saying there will not be disenfranchisement. 

The amount of cards yet to be distributed is enormous and I believe that with a voting population of about 60 million registered voters there will be disenfranchisement.

I believe it is a new dimension which the courts have to look into and which lawyers have to look into is that the law says if a high percentage of registered voters are disenfranchised, the law is clear that there must be a new election, the election has to be cancelled.
Everybody has a right to vote and it is enshrined in the Constitution and if you disenfranchise them, that election has to be cancelled.  It is a new phenomenon that we have to look into.
